Welcome to our website subscription service! These Terms and Conditions ("Terms") govern your use of our subscription options. Please read these Terms carefully before subscribing to our services. By subscribing, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not subscribe to our services.

1. Ownership of Design, Template, and Layout

The design, template, and layout of our website subscription service are owned by Creative Element, LLC ("Creative Element"). All rights, title, and interest in the design, template, and layout remain the exclusive property of Creative Element. You are granted a limited, non-exclusive, non-transferable right to use the design, template, and layout solely for the purpose of accessing and utilizing the subscribed services.

2. Post-Launch Updates and Maintenance

Once the initial website build is considered complete and the site has been launched, any subsequent content changes, updates, or modifications requested by the client are subject to additional fees.

  • Billing Structure: Post-launch requests are billed separately from the subscription fee.
  • Incremental Billing: All additional work is billed in 15-minute (quarter-hour) increments.
  • Payment Terms: Invoices for these updates will be issued upon completion of the requested tasks.
3. Subscription Cancellation
  • a. Notice Period: If you wish to cancel your subscription, you must provide 30 days' written notice to Creative Element. The notice should be sent via email to the address provided on our website. The cancellation will be effective at the end of the 30-day notice period.
  • b. Minimum Commitment: All subscriptions come with a minimum 12-month commitment period. You are able to cancel before the 12-month mark, but you will still be responsible for the full 12 months' payment, regardless of early cancellation.
  • c. Charges During Notice Period: During the notice period, you will still be charged at the interval you selected for your subscription. Cancellation does not relieve you of any outstanding financial obligations for the current subscription period.
4. Billing and Charges
  • a. Interval Charges: By subscribing to our services, you authorize Creative Element to charge the applicable subscription fee at the interval you selected (e.g., monthly, annually) until you cancel your subscription.
  • b. Payment Information: You agree to provide accurate, current, and complete payment information. You authorize Creative Element to charge the provided payment method for the subscription fee. You are responsible for any fees or charges imposed by your payment provider.
5. Ownership of Content and Website
  • a. Content Export: In the event of subscription cancellation, you will be able to export and move the content you have created or uploaded to our website platform. Creative Element shall not be held responsible for any issues arising from the export or subsequent use of the exported content.
  • b. Ownership of Design and Website: The design, template, and website itself, including all associated intellectual property rights, remain the exclusive property of Creative Element, even after subscription cancellation. You may not reproduce, modify, distribute, or create derivative works from the design, template, or website without explicit written permission from Creative Element.
6. Modifications and Termination
  • a. Modifications: Creative Element reserves the right to modify, suspend, or terminate the subscription options, in whole or in part, at any time. We will make reasonable efforts to notify active subscribers of any material changes.
  • b. Termination: Creative Element may terminate your subscription if you violate these Terms or engage in activity deemed harmful or disruptive to our platform or other users.
7. Disclaimer of Warranty and Limitation of Liability
  • a. Warranty Disclaimer: Services are provided on an "as-is" and "as-available" basis. Creative Element does not warrant that the subscription options will be uninterrupted, error-free, or free of harmful components.
  • b. Limitation of Liability: In no event shall Creative Element be liable for any direct, indirect, incidental, or consequential damages arising out of your use or inability to use our services.
8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Texas. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
